Dobânzi plafonate la creditele de consum acordate de IFN-uri

Începând de luni, 11 noiembrie, românii vor beneficia de o reducere a ratelor maxime pentru creditele de consum contractate de instituțiile financiare nebancare (IFN-uri). Aceasta măsură este rezultatul unei legi adoptate recent de Parlament, care are ca scop protejarea consumatorilor.

Legea aduce o schimbare importantă, limitând dobânzile și amendamentează regulile privind rambursarea creditelor. O noutate majoră constă în faptul că suma totală rambursată de împrumutați nu va mai putea depăși dublul valorii inițiale a creditului. Această prevedere este extrem de relevantă, având în vedere că în prezent există IFN-uri care impun dobânzi exorbitante, ajungând chiar și la 1.000%. Aceasta înseamnă că persoanele împrumutate se confruntă cu obligații de plată care sunt de câteva ori mai mari decât sumele împrumutate.

Noua lege va fi aplicată și contractelor în derulare, iar persoanele care au credite la IFN-uri pot solicita aceste reglementări. În martie, Parlamentul a adoptat un proiect de lege care limitează dobânzile atât pentru creditele ipotecare, cât și pentru cele de consum, de până la 100.000 de lei. Conform noilor reglementări, costurile totale ale creditului vor fi restricționate la dublul sumei împrumutate, iar dobânda anuală efectivă (DAE) va fi plafonată.

Pentru creditele ipotecare pentru investiții imobiliare, DAE nu va depăși 8 puncte procentuale peste rata dobânzii la facilitatea de creditare. Momentan, această rată este de 8%, astfel că nivelul maxim ar putea ajunge la 16%. Pentru creditele de consum, DAE nu va putea depăși 35%, ceea ce înseamnă un plafon de 27 de puncte procentuale suplimentar.

Instituțiile Financiare Nebancare au un rol important în peisajul financiar, oferind soluții de creditare rapidă, de valori mici, care sunt destinate clienților ce nu îndeplinesc criteriile stricte ale bancilor sau au nevoie urgentă de fonduri. Totuși, este esențial ca aceste instituții să respecte noile reglementări pentru a proteja consumatorii de practici comerciale incorecte, conform Legii nr. 363/2007, care sancționează aceste încălcări.

Noua lege își propune, de asemenea, să limiteze pierderile pentru debitori, stabilind faptul că entitățile care se ocupă cu recuperarea creanțelor nu vor putea percepe sume mai mari decât datoria care a fost recunoscută de creditori la momentul încheierii contractului, inclusiv inclusiv cheltuielile legate de recuperare.
