Sindicatele cer plafonarea modificărilor unilaterale în contractele de muncă

Blocul Național Sindical propune ca angajatorii să nu poată schimba unilateral elementele cheie ale raportului de muncă, iar norma de muncă să fie stabilită doar prin negocierea colectivă cu salariații sau organizația sindicală. Amendamentele vizează proiectul de modificare a Codului Muncii, potrivit declarațiilor reprezentanților BNS în Consiliul Economic și Social.

Un amendament important propus prevede ca norma de muncă să fie convenită de comun acord, pentru a evita situațiile în care angajatul este nevoit să depună un volum mai mare de muncă fără consimțământul său, BNS considerând „o simplă consultare nu este suficientă, fiind necesar un acord real”.

Mai mult, modificările prevăd menținerea principiului conform căruia modificarea elementelor esențiale, precum programul, normele, concediile sau regulamentul intern, să se realizeze doar prin negociere colectivă. %alba24.ro% citează BNS, care cere și corelarea proiectului cu Legea dialogului social prin înlocuirea termenului ”sindicat” cu „organizația sindicală îndreptățită să negocieze contractul colectiv de muncă”.

Sindicaliștii afirmă că propunerea legislativă „întărește dialogul social și echilibrul în relațiile de muncă, prin stabilirea de comun acord a elementelor esențiale ce țin de organizarea timpului de lucru, munca de noapte, planificarea concediilor și elaborarea regulamentului intern”. Proiectul include astfel schimbări majore pentru Codul Muncii.
