Amenzi de până la 25.000 de lei pentru comercianții care refuză înlocuirea produselor neconforme

Comercianții care refuză să înlocuiască produse neconforme, fie că sunt defecte, expirate sau nu respectă promisiunile de vânzare, riscă amenzi considerabile. Toleranța până acum era limitată doar la obligația de înlocuire, dar acum s-au introdus sancțiuni clare. Plenul Camerei Deputaților a adoptat recent această măsură.

Proiectul de lege adoptat miercuri prevede sancționarea cu amenzi cuprinse între 5.000 și 25.000 de lei a refuzului nejustificat al vânzătorului de a schimba un produs neconform. Această lege a însoțit OUG 140/2021, aprobată în urmă cu șapte luni, și vizează întărirea drepturilor consumatorilor și buna funcționare a pieței interne.

Inițiatorii, un grup de parlamentari PNL, subliniază că „din păcate, legiuitorul a instituit o nouă obligaţie în sarcina vânzătorului – înlocuirea bunului neconfom – însă nu a dispus şi sancţiunile aplicabile pentru abaterile de la prevederile art. 11 alin. (7)”. Aceștia atrag atenția că lipsa sancțiunilor a dus la numeroase refuzuri nejustificate din partea comercianților.

Conform alba24.ro, modificările propuse corectează această lacună legislativă prin includerea refuzului în categoria contravențiilor sancționate amenzile care pot ajunge până la 25.000 de lei, asigurând o protecție mai eficientă consumatorilor. „Pentru a corecta omisiunea legiuitorului, propunem modificarea OUG 140/2021 şi includerea în categoria contravenţiilor sancţionate cu amendă de la 5.000 lei la 25.000 lei a nerespectării acestor prevederi”, au detaliat inițiatorii.
