ANAF Antifrauda poate trimite somatii pentru contribuabilii care refuza controlul

Recent, ANAF Antifrauda a anunțat o modificare importantă în regulile de control fiscal, conform Ordinului 128/2025, publicat în Monitorul Oficial. Acest ordin permite autorităților să trimită somatii contribuabililor care nu se prezintă la sediul ANAF când sunt solicitați.

Somatia este un document prin care un contribuabil sau un platitor este obligat să se prezinte la sediul Direcției generale sau regionale antifraudă fiscală pentru a continua controlul. Aceasta se emite în situațiile în care contribuabilul a ignorat invitațiile anterioare ale inspectorilor antifraudă și, prin urmare, refuză să prezinte documentele necesare pentru verificările fiscale, împiedicând astfel aceste controale.

Este important de menționat că, dacă contribuabilul nu răspunde la somatia primită în termen de 15 zile, se pot aplica prevederile legale menționate în Legea nr. 241/2005, referitoare la prevenirea și combaterea evaziunii fiscale. Conform acestei legi, refuzul nejustificat de a prezenta documentele legale se poate pedepsi cu închisoare de la un an până la șase ani.

Referatul care susține aprobarea acestui ordin subliniază că, de multe ori, contribuabilii nu respectă solicitările inspectorilor de a prezenta documente. Aceasta duce la elaborarea de acte care pot conduce la sesizarea organelor de urmărire penală.

Această măsură este menită să asigure conformarea contribuabililor și să prevină evaziunea fiscală, întărind astfel procesul de control fiscal în România.
