Diferențele între pensiile încasate și cele cuvenite se recuperează

În urma unei decizii luate de Înalta Curte de Casație și Justiție (ICCJ), diferențele dintre sumele primite de pensionari și cele legal cuvenite vor fi returnate. Curtea a stabilit că aceste sume trebuie restituite în ambele sensuri, ceea ce înseamnă că, în funcție de situație, pensionarii pot primi banii înapoi sau, în cazul în care pensia încasată a fost mai mare, trebuie să returneze diferența.

Conform unei hotărâri pronunțate în ședință publică pe 3 martie 2025, „Decizia nr. 4: Admite recursul în interesul legii formulat de Colegiul de conducere al Curții de Apel Brașov”. Decizia impune ca plata acestor diferențe să fie calculată regresiv, astfel încât să se țină cont de data la care au fost constatate discrepanțele.

Curtea de Apel Brașov a solicitat ICCJ să clarifice dacă prevederile legii se referă la regimul general al prescripției. "Dacă prevederile art. 107 alin. (2) din Legea nr. 263/2010 privind sistemul unitar de pensii publice” fac trimitere la regimul general al prescripției sau instituie un regim propriu, este o problemă de drept ce a creat divergențe în practica judiciară.

De asemenea, se subliniază că drepturile de pensie greșit stabilite și plătite pot fi recuperate doar pentru ultimii trei ani anteriori constatării diferențelor. Totuși, durata totală a perioadei în care s-au înregistrat aceste probleme poate fi mai mare. Art. 107, alin. (1) din aceeași lege prevede că, în situația în care apar discrepanțe, casa de pensii va opera modificările necesare, fie din oficiu, fie la cererea pensionarului.
