ANAF ar putea executa firmele care nu plătesc la timp facturile partenerilor

O propunere legislativă aflată în dezbatere parlamentară introduce în Codul de procedură fiscală un nou articol numit „Executarea silită împotriva debitorilor debitorului”. Astfel, ANAF ar putea executa silit direct firmele care nu își achită la timp facturile către partenerii lor comerciali.

Potrivit proiectului, un contribuabil poate sesiza ANAF după o somație de 10 zile. Fiscul are apoi 5 zile să analizeze documentele și să decidă dacă emite titlu de creanță. Terțul-debitor are la rândul său 10 zile să plătească datoria fiscală sau factura restantă, după care poate fi executat silit.

„Intenția legii, de a proteja firmele care se sufocă pentru că nu își pot încasa facturile, este legitimă. Problema este instrumentul ales: în forma actuală, riscăm să transformăm ANAF în judecător comercial de urgență și să mutăm conflictul din sala de judecată direct în biroul de executări fiscale”, a explicat Cornelia Năstase, CEO CC Tax Advisory.

Conform alba24.ro, noul mecanism face ca ANAF să intervină direct în relația comercială dintre două companii, apreciind dacă există o datorie „certă, lichidă și exigibilă”. Dacă da, instituția poate emite un titlu de creanță și poate începe executarea silită împotriva terțului-debitor, ceea ce poate duce la riscuri de abuz și presiune între firme.
